    Dear Members,

    We would like to keep you informed about the ongoing issues regarding recent posts in the forum. We first direct everyone’s attention to the forum Registration Agreement Terms all forum members agreed to when registering to use the forum. In particular, “you acknowledge that all posts made to these forums express the views and opinions of the author and not the administrators, moderators or webmaster and hence will not be held liable.”

    Rest assured we will not stop anyone from posting truthful, factual information on this forum. Recent attempts have been made to scare the SubCommittee into removing posts. These attempts are without merit. The SubCommittee has consulted with an attorney and has taken appropriate action in response to the notice received.

    Unfortunately, such complaints and tactics are not uncommon in today’s world. These complaints are often referred to as Strategic Lawsuits Against Public Participation, or SLAPPs. While most SLAPPs are legally meritless, the purpose is to chill public debate on an issue. Many states have enacted anti-SLAPP laws to protect free speech. Furthermore, the First Amendment also protects free speech.

    The SubCommittee strives for truthfulness, balance and accuracy and would be concerned if any information posted on the forum is false or misleading. Truth is an absolute defense to a defamation claim. You can protect yourself by not writing rumors, or scandalous innuendo. Diligent fact-checking will help protect you against defamation accusations. Always be sure your sources are legitimate. Please report any posts you believe violate the forum rules to the moderator, rather than taking it upon yourself to write a retaliatory response. Ultimately, if you have questions about your written content, you should seek legal advice before posting the comment, or not post it at all. If you question it, that is a red flag.

    Please remember you rely upon the information on the forum at your own risk. The SubCommittee does not have the resources to verify each and every post. You take responsibility for your comments on the board as an author of a post. The SubCommittee does not take responsibility for third party content or third party opinions posted on the forum.

    We hope this will resolve any issues that remain in regards to the forum and lead us all to the ultimate enjoyment in our various submarine hobby pastimes.
